MANY RIVERS COMMUNITY ACUPUNCTURE, LLC TEXT MESSAGING PRIVACY POLICY

This Messaging Privacy Policy explains how Many Rivers Community Acupuncture, LLC (“Many Rivers”) collects and uses information about you in relation to its text message program (the “Messaging Service”). We use Ooma Office and Jane App to provide the Messaging Service to you. For the purposes of the Messaging Service, Ooma Office and Jane App act as our service provider and data processor of your information.

Text Messaging Uses

Many Rivers does not utilize text messaging for marketing purposes.  We will never text you for promotional reasons.

Many Rivers utilizes text messaging for scheduling, billing, and other patient communication.  Please note that text messaging is not HIPAA compliant and we will not discuss private health information via text messaging.  To communicate private health information to us, you must use the Secure Messaging Feature in the Jane App.

Opting In – Consent to Receive Text Messages

You can opt-in to messaging with Many Rivers by:

• Sending a text message to the clinic phone number.
• Clicking a box giving your consent to receive text messages in your new patient paperwork.
• Clicking a box giving your consent to receive text messages via our online schedule at manyrivers.janeapp.com or on the Jane app.

Opting Out

You can opt out of receiving text messaging at any time by texting “STOP.”

Collection of Information

We collect various information on our behalf from and about you, including information you directly provide when you use the Messaging Service. For example, we collect the phone number you provided when signing up for the Messaging Service. When you send messages via the Messaging Service, we will also collect your messaging history and any information included in those messages.

Use of Information

We use your information to deliver, analyze, maintain and support the Messaging Service.

Sharing of Information

We respect your privacy. We only use information you provide through this service to transmit your text messages and respond to you. This includes, but isn’t limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages.

We will not share, rent or sell your Personal Information to third parties for marketing purposes.

We will not share, rent, or sell your Personal Information to other companies or individuals, unless we have your consent, or in the folloiwng limited circumstances:

• We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights, or the legal rights of others, or defend against legal claims.
• If Many Rivers is, or its assets are, acquired by or merged with another company.

Protection of Information

We take a variety of physical, technical, administrative, and organizational security measures based on the sensitivity of the information we collect to protect your information against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access. Unfortunately, no online activity can be guaranteed to be 100% secure. While we strive to protect your information against unauthorized use or disclosure, we cannot ensure or warrant the security of any information you provide.

We do not accept liability for unintentional disclosure.

Retention of Information

We retain your information for as long as you participate in the Messaging Service or as needed to comply with applicable legal obligations. We will also retain and use your information as necessary to resolve disputes, protect us and our patients, and enforce our agreements.

Message and data rates may apply, depending on your personal service provider.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties
